Senator Aisha Ahmed Binani, the APC candidate for governor of Adamawa State, filed an appeal with the Federal High Court in Abuja, seeking the court to certify her as the winner of the election that took place on April 15th. The appeal was denied.
Once he understood that the plaintiff had requested to have her complaint withdrawn, Justice Inyang Ekwo dismissed the case.
Justice Ekwo denied her attorney Mohammed Sheriff's plea to withdraw from the lawsuit, stating that dismissing the matter was the proper course of action.
He claims that the plaintiff was initially obliged to provide justification for her filing of the action by the court.
Senator Binani moved to court earlier to ask it to prevent INEC from announcing anyone as the winner of the state governorship race after Hudu Ari, the state election commissioner, proclaimed her the victor.
The APC candidate requested in her lawsuit that she be recognized as the victor of the April 15 governor's race in Adamawa state.
She asserted that once she has been proclaimed the winner by the agency's office, INEC lacks the jurisdiction to withdraw or re-declare any candidate.
